On Thursday, April 27, 2017, a woman was arrested for suspicion of driving under the influence after she hit a pedestrian. Her BMW SUV allegedly hit the man around 4AM near the intersection of Beach Boulevard north of Edinger Avenue. This was likely after exiting the 405 prior to going under the bridge before the Infiniti dealership.
According to an NBC LA article, the driver made the call to police saying that she wasn’t sure if she had hit the man or not, but she saw him in the road after hitting a pole. It would seem that the “pole” may have actually been a person. Tragically, the man later died from his injuries at a local hospital. She is now looking at a Felony DUI. How she is charged for this depends on the unique circumstances of the crash, but she is looking at some time in the slammer, and the family of the victim is likely to pursue a civil case.
The drunk driver who caused an accident can be held liable for damages in a civil lawsuit or a wrongful death suit, according to this lawyer’s DUI injury page. DUI accidents are always accidents which shouldn’t have happened, and drivers who are arrested for felony DUI are obviously negligent. Obtaining compensation from an insurer is whole new story though, which is why people hire personal injury attorneys.
OC Register and NBC haven’t updated their articles since the crash occurred. If you have any additional information on this crash please feel free to comment in the comments section below.
California has one of the highest drunk driving rates in the USA and around 700 people are killed by DUI drivers in the state each year.
